That is probably true except where there may be some overlap with trademark issues. Then, it seems that large corporations are very aggressive about protecting the trademark.

I don't intend to defend some of the bad verdicts that make the news, but that is why they made the news, there unusal. The fact is in the area of damages the average jury verdict is less than the average bench verdict in tort claims. I think we often forget that what is reported in the news is very unreliable and the juries get to hear the whole story.

i think the worst verdict i ever read about was from mi if i recall correctly.

dude bought a new rv. was tooling down the interstate, put it on cruise control and went back to the kitchen to make himself a cup of coffee.

blamed the mfgr for the accident and sued. jury gave him a new rv and a six figure sum. should have committed him, and them, accomodation for the mentally defective. just another bit of evidence that that human trait known as common sense is perhaps one the the species least common attributes.

I don't know about that Dave. Look at the rising number of copyright infringement cases against small establishments for having Live Musical Entertainment and not going through the proper licensing and making royalty payments.

Since Nelson warned about Deere applying for patents on sqaure holes, that kills the square soundhole design unless it is finished in Green and Yellow
